Poor slugged for court fees as boatpeople illegal immigrants get free ride
PEOPLE held in immigration detention have been given an exemption from court fees whenever they wish to take legal action aimed at remaining in Australia.
The exemption has come to light at the same Senate inquiry that revealed the government has almost doubled the cost of many court fees since 2010 with the aim of bringing in an additional $104.2 million over four years.
The fee exemption for those in immigration detention coincides with a surge in migration litigation and has triggered a furious response from the Coalition.
“The Gillard government has put the needs of asylum-seekers illegal immigrants above the needs of Australian citizens in obtaining access to justice,” said opposition legal affairs spokesman George Brandis.
“Why should the federal courts be free to non-citizens, who have come to Australia unlawfully, but expensive to everyday Australian taxpayers whose need for access to justice is no less great?”.
