     HHS secretary Becerra — his hand is heavily in this — is too well known to me. He was state assemblyman of a neighboring district before becoming my Congressman in 1992. He was heavily backed by the wealthy “libs” aka Marxists in Mt Washington. Then appointed CA AG before Biden made him HHS. Damned Marxist from the get go.

             According to this, he has the authority to do intra-session appointments at anytime the Senate lacks the capability to conduct business. So, I’m guessing just as soon as they head home for the holidays.

               This is how 1790 recess differs from 2024. Washington was the sitting president for 1790 and had authority. Trump, not currently sitting, does not have authority in 2024.

               But in 2025 the majority leader promised that he would not keep a rump Senate during recesses for Trump’s term in office.

               That means if he holds out until the Spring recess, he will be able to make his first recess appointments. Obama made over 30. Trump none because rump senates. Biden none — didn’t need to.

               On a further positive note, take Trump’s nomination of Gaetz for AG as an example. Gaetz hangs as a threat. If they don’t confirm Gaetz, Trump can nominate others for AG they also hate knowing that a vacancy at AG leaves the vacancy for Gaetz to fill during recess. Heh, heh. The art of the deal. Repeat as often as he likes in his first 100 days.

                 True, but I kinda wonder what Trump and Biden talked about for two hours the other day? I wonder if Biden wants some payback for the dems pulling the rug out from under him? What happens if Biden makes Trump’s recess appointments for him in exchange for a pardon or two? It might be crazy idea, but I think there is a better chance of Biden appointing people like Gaetz than the new RINO led Senate. If the RINOs get their way, we will end up with a full slate of new deep state lackeys running everything and will have squandered yet another majority , because the mid-terms will be brutal.

   Apparently with Speaker Johnson on board with recess appointments, he can declare a recess of the House and the President can force the Senate into recess when the two houses are in disagreement on recess. According to Article 2 of our constitution. It’s never been invoked before.
