For those of you not familiar-In the US,when you want to buy a gun from a dealer,gunstore,online retailer,gunshow vendor or sporting goods store you must file a form 4473 better known as the NICS background check-

It’s mostly done online in an instant check format and usually takes less than 5 minutes.You must give your full name,basic identification and swear under penalty of law that you are not a convcited felon or have been ajudicated mentally ill etc before siging it and submitting it for approval.If it comes back clean,you pay your transfer fee,usually $20-40 to the vendor,pay for your purchase and off you go.

If it doesn’t come back clean,well things can and are supposed to get difficult.Number one the vendor will not tranfer the gun to you until you have been approved.Number two if you do have a felony conviction you maybe be subject to arrest and imprisonment.

The only exceptions to this requirment is if you have your own FFL(Federal Firearms License) or if you have a CCP (Concealed Carry Permit) in those cases you don’t have to do the 4473 because you have already gone through an extensive FBI background check to get your license.

There are a couple ways people can slip through the cracks in this system.One,local authorities can simply forget or simply not follow federal reporting guidelines and not report a felony conviction to the FBI.

The second way,when someone with an agenda to drive decides to have 500,000 names deleted from the registry.

    According to the article, it was the DoJ Law Office that made the determination that unless the fugitive crossed a state line, they were not considered a Federal fugitive and therefore should not be listed on the NICS database. I’m not sure of the level of scrutiny within a state but if they are a fugitive from a warrant on a felony crime, are they still eligible if they have not been convicted?http://falfn.com/CrusaderRabbit/wp-content/plugins/wp-monalisa/icons/wpml_scratch.gif

        Fix NICS doesn’t propose to control guns. It’s not gun control, it’s people control.

        The angle is that this piece is an attempt to elicit support of conservatives and republicans for Fix NICS by demonstrating that Obama is bad, criminals are bad, and law and order (AT GUNPOINT by the way) is good. It’s propaganda.

        Half a million names were removed from NICS? Good, now do that every month until the database is empty, turn off the computers and throw them in the trash. That is the only way Fix NICS.

        What’s never reported is the very high number of gun buys that are rejected by gun store salesman and store owners because the guy trying to buy is obviously a criminal or an idiot. Are they in NICS? Almost never. What NICS does is ALLOW gun stores to sell to people that they might not otherwise sell too. Ya know, like some kid in Florida who is obviously on Psychotropic prescription meds.

          I’ve been away from the US for over 30 years so I am unfamiliar with the discretion given to gun salesmen. Are any ever sued for not selling a gun to someone not in the NICS or do they have wide discretionary powers? I know there was one that refused to sell to the kid in Florida and others won’t sell to under 21s but how much leeway do they have?

            So, outside of the recent 18 to 21 years old brew ha ha, no. They don’t have wide discretionary powers but what they do is, after the guy leaves, they call police and report him as suspicious, to cover their backsides as it were. I’ve never heard of somebody filing a lawsuit over being rejected by a store owner but probably because the persons are indeed criminals or idiots, which is my point.

            The US Justice Dept (ATF/FBI) will be up your backside with a super high powered microscope if you DO sell to somebody who then commits a crime so the legal system’s tables are generally tilted away from bugging store owners who use description in the first place. The gun dealers are federally licensed as you probably know so, it’s sort of like telling the state that ‘you gave me a drivers license and in this case I didn’t feel safe driving 55, so I went 40′ as a bad analogy. I’m sure that the one who refused the kid in Florida called the cops, I mean, EVERYBODY called the cops on this kid.

            In short, lot’s of leeway is given. (but this is one of the few area’s where common sense is still observed instead of letting freakin’ lawyers ruin everything.)

            Now, I’m in the camp of advocating that the Second Amendment is a civil right and the rejected party could indeed file a lawsuit. Sadly, gun rights aren’t treated as the civil right that is intended by the constitution…

            ..but where is provable harm? Having said that, I believe in freedom of association and it’s not hard to get a gun so if somebody (a real person) doesn’t want to sell one to me, it’s no big deal. If somebody doesn’t want negroes in their restaurant he’s not dooming them to starvation, for example. But that’s just me.

    Fred,this is the way I see it.
    I don’t think this has anything to do with NICS,this is standard boiler plate creating a crisis so they can fix it BS.Obama released 600,000 “non-violent drug offenders” back on to the streets.Most of these were snagged and bagged under Clinton’s three strikes policy.As a friend who is a former county prosecutor told me,2/3 of those people were guilty of violent crimes when they were caught,everything from felony assualt to murder.Only the prosecutors didn’t have enough evidence to convict them for those offenses,so they took the low hanging fruit and got them put away on the drug possesion charges which were a slam dunk.
    So now Obama and Holder turn this clown loose,they swing the doors wide open on the southern border letting in MS-13 gang members as “unaccompnied minors” and at a the same time stopped deporting criminal illegal aliens.-Presto-Instant crime wave in the making.
    They knew full well that the American people in no way would support anymore gun control with gun ownership going up at the same time crime was going down,so they decided to fix that little issue.I think this NICS purge was just the tail end of that track which Hillary was intended to carry on once she was in.
    So far as my feelings about NICS,well,given the current corrupt “law enforcement and criminal justice system” it’s the only thing we have helping keep the rabid grabbers at bay,which is why they have done everything they can to nullify it by not reporting mental health cases like the kid in Fla or the church shooter in Texas and god knows how many others.

    Oh,and that whole Fast and Furious criminal operation was the seed that sprouted all this mess.Remember where Obama and co went right after taking office?Mexico.

      I agree.

      I’m against any and all new gun laws. We don’t need them. It’s already a crime to assault somebody. It’s already a crime to kill somebody. What does a gun have to do with it? Nothing. They want the guns so they put us on rail cars to camps, plain and simple.

      And yes, the government of the United States of America wants it’s citizens defenseless so that it can harm them at will. It is actively pursuing this across parties and administrations. This is plainly obvious. No, they aren’t misguided or stupid or just philosophically inept. They want you dead!

      They can’t have my guns because I ain’t getting on any rail car because I ain’t going to any camp because they can’t have me guns.
