‘Police have made a rare legal move to overturn a judge’s decision giving a drink-driving sportswoman a discharge without conviction and permanent name suppression.
…She was caught driving with a breath-alcohol level of 801 micrograms per litre of breath – double the legal limit of 400mcg.
Her lawyer, Marcia Insley, said the woman had no previous convictions, had reached an “exceptional level” in her sport and had been offered a chance to compete overseas.
Judge Hubble said Ms Insley’s submission was “persuasive”, and he agreed to the discharge….’ source
The judge obviously erred in law–the drunk driver isn’t a rugby player and should therefore have been convicted and fined.

If you’re a top-level sportsman or woman, you get off.
If you’re not, you get nailed. The justice system is an ass.
My wife just took it on the chin when she got caught. Of course, if she’d listened to me before she’d have not done it at all instead of snarling back. Two weeks to go till I’m no longer taxi Tim. Strike one.
I used to drink when in NZ to give me added courage to face the traffic….
It’s really sad when one has to find an excuse to drink.
And next time when she kills a family with children will her name be published? Or will it be swept under the rug again?

It didn’t matter to the Judge when I stupidly commited the same offence that I could have lost my pharmacy registration, and my livelihood.
Get real, Murray…..what’s registration as a pharmacist, compared to being a sportswoman? Have you no sense of priorities, man?
Murray, if I get caught I’ll have to face the criminal charge first ………. and then the Medical Council gets their chance at me even if the criminal charges are dropped. Usually means some conditions applied to one’s registration and scope of practice and compulsory alcohol counseling.
No sympathy for y’all–you could have chosen a career in
thuggeryrugby and been immune to legal penalties.
