Why should anybody respect the law when the highest court in the land is divided along ideological lines? The law is now worthless.

    In my darker moments, and increasingly in my brighter ones, I am overcome by the foreboding sense we are fast approaching some distopian nether-future such as Aldous Huxley, George Orwell or Suzanne Collins couldn’t conjure in their worst nightmares.

    The hell to which we are condemning future generations is nothing short of criminal.

    Nothing in the Constitution remotely suggests that the Supreme Court should be the final word on the meaning of the Constitution. That is a power that the Court designed for itself. That was livable before the Court became, as it inevitably would, activist, acting like an unelected Politburo. Congress needs to be able to override Supreme Court decisions of Constitutional law by a supermajority and it needs to provide guidance to the Court on how decisions of Constitutional law are made – originalism. Do that and kill the regulatory system and this nation might survive – emphasis on might.

    Note that it was Joe Biden, Ted Kennedy (may he rest in hell), and the decision of the Court in Roe v. Wade (may Justice Blackmun and his penumbras rest in hell) that turned the Supreme Court into a political rather than a legal body, establishing left wing litmus tests for judges and demanding activism over originalism. Even Justice Ginsburgh, one of the three harpies now on the Court, called that a wrong decision. There are only two reasons to give the Court any respect today – Justices Scalia and Thomas.

      The term “black-robed tyrants” suits them well, GW. And they’d be close to the top of my wish list for the scaffold, come the day.
      There’s black letter law, or there are mere opinions.
      And I don’t feel inclined to give much moral weight to mere opinions of political appointees.

      The Court’s been both political and activist since Marbury v Madison.

      But I do agree it’s become nakedly tyrannical, likely beginning with Roe.

      In his new book The Liberty Amendments Mark Levin suggests a mechanism to overturn SC decisions. One is a super-majority of both Houses and the other is (IIRC) two-thirds of the States. It’s gotta be done (along with term limits across the board). The SC is the only branch without any body reviewing and overseeing, and it’s gone rogue.

      It’s getting to be an old drum I’m banging, but conservatives need to pull their head out of the sand, stake a claim to some turf and secede from whatever nation it is they call home.

      The alternative is to sink in this political quicksand together, which will soon result in the frenzied scramble to be the last one to go under.

      Of course, I’m wasting my breath. I know full well that we’ll all pretend that nationalist democracy will save us right up until the point when the lights go off for good and we’re left sitting in our loungerooms waiting for the looters, rapists and murderers to work their way around the block.

    I don’t know if the sex of the SCOTUS members is as important in this instance. I would think it is more that the three women on the court are all extreme leftists.
