      Not in NZ, K2. I think this is covered by NZ’s Accident Compensation scheme, which doesn’t allow a victim to sue.
      I may be wrong here, but somebody will know.

        My guess is others would know better, but I’m sure there’s (in addition to ACC) some liability under medical malpractice. I would imagine the threshold to be high, but I do vaguely recall articles in the past where doctors have been sued in cases of blatant incompetence or abject stupidity.

        NZ has a ” no fault” system so accidents such as this are covered by ACC which is great as it keeps malpractice insurance very low which does feed back to the consumer as lower medical fees or public health Drs salaries.

        I don’t know of any private malpractice suites in NZ. The Medical Council includes a fee in the annual practicing certificate of Drs to fund the Councils malpractice and complaints committees. There is a very low bar to accepting complaints. The Health and Disability Commisioner is more active in censuring Drs. There have been prosecutions by the police for wrongful death, etc in NZ.

      Not quite true. I doubt any other profession is under such scrutiny.

      They say that lawyers leave theirs hanging. . .

        Here in OZ when you die from a preventable cause in a hospital it’s simply labelled as a “medical complication”.

        One of the biggest is MRSA infections post surgery. Absolutely 100% the fault of the hospital but in most instances the cause of death is listed as “post surgery complication” and the family don’t know to start digging.

        My wife has been an RN for less than a decade and she could keep you up all night with stories of malpractice occasioning untimely death that flew right under the radar.

        You have to work side by side with these people as I have to know the kind of darkness that lies beneath the smiles and the sweetness.

    But in true Leftist fashion, no person is responsible. It is just a systems error.
    The letter, signed by directors Mark Newton and John Phipps, said the company was investigating the cause of the incorrect supply, as well as “reviewing our dispensing procedures and checking systems relating to the supply of items to the clinic to prevent future errors”. And if that is an apology as claimed by the NZ Herald then to plagiarise Sarah Palin, I’m the King of England!

    I’m currently dealing with my (large) local NZ hospital, for a very unpleasant and serious condition.
    Let me say this:
    I have never met a more efficient, professional, caring and well-organised bunch of people within a single organization. Never.
